3. Accounts & Security

  • You are responsible for maintaining the confidentiality of your account credentials and any actions taken under your account.

  • Notify us immediately if you suspect unauthorized access.

4. Communications via WhatsApp

  • By contacting us via WhatsApp, you consent to receiving replies, service updates, confirmations, and—if you opt in—promotional content.

  • You must ensure that the number you provide is yours and that you have the right to receive WhatsApp messages.

  • WhatsApp messages are subject to Meta’s infrastructure and policies. Nexy-Soft is not responsible for WhatsApp outages, delays, or delivery issues.

5. Payments & Subscriptions

If you subscribe to paid Services:

  • Billing: You authorize us to charge your provided payment method for applicable fees, including recurring subscriptions where agreed.

  • Refunds: Except where required by law, payments are non-refundable.

  • Taxes: You are responsible for applicable taxes in your jurisdiction.

6. Intellectual Property

  • All content, software, designs, and materials we provide are owned by Nexy-Soft or our licensors.

  • You are granted a limited, non-exclusive, non-transferable license to use the Services.

  • You may not copy, modify, resell, or distribute our content without written permission.

7. Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection and use of your data as described there.

8. Third-Party Services

Our Services may integrate with third parties (e.g., WhatsApp, Meta, Loyverse, payment processors). We are not responsible for their content, policies, or outages. Your use of those services is subject to their terms.

  • We do not guarantee uninterrupted, error-free, or secure service.

  • We disclaim all warranties, express or implied, including fitness for a particular purpose.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Nexy-Soft shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

  • Our total liability for any claim shall not exceed the amount you paid us in the 3 months before the claim.

You may also terminate use at any time by discontinuing access.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of Suriname, without regard to conflicts of law. Disputes shall be resolved exclusively in the courts of Paramaribo, Suriname.

We may update these Terms from time to time. If we make material changes, we will post the revised Terms on our website with an updated date. Continued use of the Services after changes constitutes acceptance.
